Terms of Service

By accessing and using Fade ("the App" or "the Service"), you accept and agree to be bound by these Terms of Service and our Privacy Policy.

Summary

  • Fade connects you with hair salons; your contract for the haircut or grooming service is with the salon, not with us.
  • Loyalty points, rewards, and QR redemptions reflect each salon's programme: the salon (not us) is responsible for honouring them; points have no cash value from Vera IT / Fade. Confirm important reward details at the salon if needed.
  • You must inform salons of allergies or health conditions that may affect the service.
  • We are not liable for salon services, quality, or conduct.
  • In-app purchases in Fade are mainly for salon business features (subscriptions, Featured, coupons)—not for charging your card for a consumer haircut unless the salon offers that separately.
  • Salons must follow these Terms: honour bookings and promotions fairly, respect clients and platform rules, and comply with rules on rewards and redemptions.
  • Support tickets and in-app notifications are part of the platform; use them fairly (no abuse).

1. Acceptance of Terms

By accessing and using Fade ("the App" or "the Service"), you accept and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Vera IT ("we", "us", "our"). If you do not agree, please do not use the App. We recommend that you save or print a copy of these Terms for future reference.

Key terms (used in these Terms)

  • App / Platform: The Fade mobile application and website (getfadeapp.com)
  • User / Client: You, the person using the App to discover and book salon services
  • Salon / Partner: A hair salon or barbershop listed on the platform that provides services
  • Booking / Appointment: A reservation you make for a service at a salon through the App
  • Service: The hair or grooming service provided by a salon

2. Description of Service

Fade provides:

  • A platform to discover and book appointments at hair salons
  • Location-based salon search and mapping
  • Direct communication with salons (including automated booking-related messages in chat)
  • In-app notification feed (bookings, messages, system notices) and push notifications
  • Customer support tickets (in-app)
  • Reviews and ratings system
  • Loyalty points, QR code check-in, referral and coupon features where enabled
  • Payment processing for salon-side subscriptions and promotions (Apple, Google Play, Stripe on the web)—see below

We act as an intermediary between you and salons. When you make a booking, the contract for the haircut or grooming service is between you and the salon. Payment for that service is typically arranged with the salon (e.g. at the venue) unless the salon uses another method they communicate to you; Fade does not process consumer card payments for individual haircuts in the app by default. In-app purchases through Fade are primarily for salon business plans (Starter/Medium/Pro), Featured placement, and related promotional products—not for charging end customers for a haircut unless explicitly offered by the salon through a separate flow.

We are not a party to the salon service contract and are not responsible for the salon's services, quality, or conduct.

The service is provided "as is" and we reserve the right to modify or discontinue any feature at any time.

3. User Accounts

To use certain features, you must create an account:

  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • You must be at least 13 years old to create an account
  • One person may not maintain multiple accounts
  • You must not share your account credentials

We reserve the right to suspend or terminate accounts that violate these terms.

4. User Conduct

You agree NOT to:

  • Use the App for any illegal purpose
  • Harass, abuse, or harm other users or salons
  • Post false or misleading information
  • Attempt to gain unauthorized access to the system
  • Interfere with the proper functioning of the App
  • Use automated systems (bots) without permission
  • Collect user data without consent
  • Impersonate another person or entity
  • Misuse support tickets (spam, threats, flooding)—we may close tickets or restrict access if support is abused

5. Bookings and Payments

When making a booking:

  • You agree to arrive on time for your appointment
  • You are responsible for informing the salon of any allergies, health conditions, medications, or special needs that may affect the service. Failure to do so may result in harm; neither we nor the salon are liable for consequences that could reasonably have been avoided if you had disclosed this information.
  • Cancellation policies are set by individual salons
  • Deposits may be required and are non-refundable in case of no-show
  • You are responsible for any charges incurred
  • Payment for salon subscriptions / Featured / coupons in the mobile app: processed by Apple (iOS) or Google Play (Android). On the website (getfadeapp.com), salon subscriptions are processed by Stripe. We do not store card details.
  • Payment for your haircut or service at the salon: usually paid directly to the salon (e.g. at the venue) unless the salon communicates another method. Fade is not your payment provider for that consumer service unless explicitly stated by the salon.
  • Prices are set by salons and may change without notice

Loyalty points, rewards, coupons, and QR redemptions (client users)

  • These features implement each salon's own programme as configured and shown in the App. The salon—not Vera IT (Fade)—is solely responsible for honouring valid redemptions and for providing the benefit (discount, free or reduced service, or other perk) that the reward represents, subject to applicable consumer law.
  • The App shows rewards and rules as the salon has set them up; details or availability may still differ in practice (e.g. stock, staffing, or same-day changes). For anything important—especially before you travel or count on a specific perk—we recommend you confirm directly with the salon (in person or via contact/chat). What the salon confirms to you for their business applies to their programme alongside what you see in the App.
  • Loyalty points have no cash value payable by Vera IT / Fade and are not our debt. We do not guarantee that any salon will always comply; disputes about points, rewards, or the value of a perk are primarily between you and the salon. You should contact the salon first. We may take platform action (e.g. against abuse) under these Terms but are not a party to the reward obligation between you and the salon.
  • You use loyalty and reward features at your own risk as between you and the salon; our liability remains limited as in section 9 (except where mandatory law requires otherwise).

By using Fade you agree to receive service communications (e.g. booking confirmations, reminders, messages from salons) via push notification, email, or in-app. You can disable push notifications in device settings.

We are not responsible for disputes between users and salons.

5b. Subscriptions and In-App Purchases

Salons can subscribe to Starter, Medium, or Pro packages. Featured promotions are also available.

Appointment reminders: Salons on Starter can send weekly reminders only to clients who have added them to "My Hairdresser" (favorites). Medium and Pro salons can send reminders to all clients with appointments. At most one reminder per week per appointment (enforced in the app). See our Privacy Policy for details.

  • Mobile app: Subscriptions and promotions are billed via Apple (iOS) or Google Play (Android). Auto-renew unless canceled at least 24 hours before renewal. Refunds follow Apple/Google policies.
  • Website: Salon subscriptions via getfadeapp.com are processed by Stripe.
  • To cancel: iOS: Settings → Subscriptions → Fade. Android: Google Play → Subscriptions → Fade. Web: Contact support or manage in dashboard.
  • Prices include VAT. See pricing in the app or on our website.

5a. Salon's Right to Refuse or Cancel

Salons have the right to refuse, reject, or cancel a booking at their discretion when they reasonably determine that something is not in order, including but not limited to:

  • Safety concerns (threat, aggressive behavior, risk to staff/other customers)
  • Hygiene or health (infectious disease, allergies that cannot be accommodated)
  • Privacy or identity concerns
  • Capacity (fully booked, understaffed, cannot provide service)
  • Professional judgment (service cannot be performed safely)
  • Fraud or misuse (suspected fraudulent booking, fake identity)
  • Customer history (repeated no-shows, past misconduct)
  • Legal or regulatory compliance
  • Other legitimate business reasons

The salon should inform you as soon as reasonably possible. Fade does not interfere with a salon's decision and is not liable for any refusal. Disputes are between you and the salon.

6. Reviews and Ratings

When posting reviews:

  • Reviews must be honest and based on your experience
  • Do not post offensive, defamatory, or inappropriate content
  • Do not post fake reviews or reviews for competitors
  • We reserve the right to remove reviews that violate these terms
  • Salons may respond to your reviews

You retain ownership of your review content, but grant us a license to use it.

7. Intellectual Property

All content in the App is owned by Vera IT or its licensors:

  • App design, logo, and branding are our trademarks
  • You may not copy, modify, or distribute our content
  • User-generated content (reviews, photos) remains your property
  • By posting content, you grant us a license to use it

Unauthorized use may result in legal action.

8. Salon partners — rules, obligations, rewards, and enforcement

These rules apply to salon owners and staff using Fade on behalf of a salon. By operating a salon account you agree to them. Salons are independent businesses; Fade provides software and visibility tools. You remain responsible for your services, staff, and legal compliance.

8.1 Scope and acceptance

  • You must comply with these Terms, our Privacy Policy, and any additional rules we publish in the App or on getfadeapp.com (including pricing and product descriptions for subscriptions and Featured).
  • Fade does not employ salon staff and is not a party to the contract between a client and your salon for the actual haircut or grooming service.

8.2 What salons must do

  • Keep business information accurate and up to date (name, address, contact, hours, services, prices where shown).
  • Honour bookings made through the App, or refuse or cancel only where permitted (including section 5a) and inform the client as soon as reasonably possible.
  • Treat clients and platform users fairly: no unlawful discrimination, harassment, or unsafe practices.
  • Comply with applicable law: e.g. trade rules, hygiene, licensing, consumer protection, and GDPR / data protection when you process personal data.
  • Pay subscription fees, Featured placement, and other charges as agreed (App Store, Google Play, or Stripe on the web as applicable).
  • Use client data received through Fade only to provide the booked service and related communications allowed by law and our Privacy Policy—not for unrelated marketing without a valid legal basis.
  • Honour promotions, coupons, loyalty points, QR check-in rules, referrals, and redemptions as configured in Fade (validity, limits, eligibility). Do not advertise benefits in the App that you do not intend to honour at the salon without clear disclosure.
  • Co-operate with Fade if we investigate complaints, suspected abuse, or legal requests, and respond to reasonable platform notices.

8.3 What salons must not do

  • Do not publish false, misleading, or defamatory information about your salon or others.
  • Do not manipulate reviews or ratings (including fake reviews, paying only for positive reviews, or coordinated harassment).
  • Do not circumvent payment or subscription rules, misuse refunds or chargebacks, or abuse free trials.
  • Do not harass clients, other salons, or our support team; do not spam support tickets or notifications.
  • Do not use Fade for unlawful services, fraud, or misrepresentation of qualifications.
  • Do not undermine reward or loyalty programmes: e.g. fictitious visits, fake redemptions, collusion to abuse offers, or hiding material conditions from clients.
  • Do not collect health or other special-category data beyond what is necessary for the service without appropriate consent where required.

8.4 Promotions, rewards, coupons, and Featured

  • All promotions, coupons, loyalty points, referrals, and Featured placements must comply with applicable advertising and consumer law.
  • You must honour valid redemptions in line with the rules shown in the App (and any matching information you give clients). Rewards must not be deceptive or impossible to obtain; material conditions and expiry should be clear.
  • Fade may suspend, remove, or limit promotional features, placements, or redemptions if we suspect abuse, fraud, or breach of these Terms.
  • Featured and paid visibility do not guarantee bookings or revenue; we do not guarantee business results.

8.4a Loyalty, rewards, and redemptions — allocation of responsibility (salons)

  • Loyalty points and rewards in the App are part of your salon's programme. You alone are responsible—vis-à-vis your clients—for defining (within the App's tools), displaying, and honouring the benefit represented by points and rewards (e.g. discounts, free or reduced services, or other perks), in compliance with applicable advertising and consumer law.
  • Vera IT (Fade) provides software only. We do not pay clients cash or cash equivalents for points. We are not the seller of the haircut or of the reward benefit; we are not a party to the obligation to perform the reward between your salon and your client, except as mandatory law may require of us.
  • Clients should contact your salon first about points balances, eligibility, or redemption. We may offer technical or operational assistance regarding the platform but are not responsible for your commercial decisions or for disputes between you and your clients regarding rewards, except as stated in these Terms or required by mandatory law.
  • You acknowledge that enabling loyalty, promotions, and QR redemption features is voluntary and for your business benefit; by using them you accept the obligations in this section and section 8.2–8.4.

8.5 Violation of rules and consequences

  • We may take action including: warning; temporary restriction of features (e.g. messaging, promotions); removal from Featured; suspension; or termination of the salon account.
  • We may act without prior notice where necessary to protect users, comply with law, or stop ongoing harm.
  • Serious or repeated breaches may result in immediate termination; refunds of unused subscription time follow App Store / Google Play / Stripe rules and applicable law.
  • Nothing in this section limits your indemnity in section 10 or statutory rights of consumers.

Salons are independent businesses. Fade is not responsible for salon services, quality, or conduct, except as required by mandatory law.

9. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages
  • We are not responsible for salon services or quality
  • We are not liable for disputes between users and salons
  • We are not liable for a salon's failure to honour loyalty points, rewards, coupons, or redemptions, or for the value or availability of any perk offered by a salon (claims lie between client and salon), except as mandatory law requires otherwise
  • Our total liability to you for the Fade platform is limited to the amount you paid us in the last 12 months (fees to Vera IT only—not salon service charges)
  • We do not guarantee uninterrupted or error-free service

Use the App at your own risk. EU consumers: nothing in these Terms limits statutory rights that cannot be waived.

10. Indemnification

You agree to indemnify and hold harmless Vera IT, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your content, your violation of these Terms or of law, or your interactions with salons or other users.

If you operate a salon account on Fade, you additionally indemnify us against claims by third parties (including clients) arising from or related to your salon services, staff, premises, loyalty or reward programmes, promotions, coupons, QR redemptions, or any dispute about points or rewards—except to the extent a court finally determines we have independent liability under mandatory law.

11. Termination

We may terminate or suspend your account:

  • For violation of these terms
  • For fraudulent or illegal activity
  • At our sole discretion with or without notice
  • Upon your request

Upon termination, your right to use the App ceases immediately.

12. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of the App constitutes acceptance of the modified terms.

13. Governing Law

These terms are governed by the laws of Germany. Any disputes will be resolved in the courts of the Federal Republic of Germany. EU consumers: nothing in these Terms limits your statutory rights. For online dispute resolution: https://ec.europa.eu/consumers/odr/

13a. Miscellaneous

Entire agreement: These Terms together with our Privacy Policy constitute the entire agreement between you and us.

Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

No waiver: Our failure to enforce any right does not waive that right.

Force majeure: We are not liable for failure or delay due to circumstances beyond our control (natural disasters, war, strikes, pandemics, government actions).
