Terms of Service

These Terms (Allgemeine Geschäftsbedingungen) apply to both customers and salons. Please read the section that applies to you.

1. Agreement and Scope

By accessing or using the Fade mobile application and website ("Service"), you agree to be bound by these Terms of Service (Terms). If you disagree with any part, you may not use the Service.

These Terms are divided into two parts: Part A applies to customers (end users who book appointments), and Part B applies to salons (business users who offer services). Additional provisions apply to all users.

2. Description of Service

Fade is a platform that connects customers with hair salons. Customers can discover salons, book appointments, and communicate with salons. Salons can manage their profile, schedules, accept or refuse bookings, and communicate with customers. Fade facilitates the connection but is not a party to the contract between customer and salon.

Part A – Terms for Customers

A.1 Account Requirements

To book appointments, you must register. You agree to:

  • Provide accurate, current, and complete information
  • Be at least 13 years old
  • Maintain account security and not share credentials
  • Notify us of unauthorized access
  • Maintain only one account per person

A.2 Bookings

When you book an appointment, you enter into a contract directly with the salon. Fade is not a party to that contract. You agree to arrive on time and respect the salon's policies. Cancellation and refund policies are set by each salon. Deposits may be required and may be non-refundable in case of no-show.

Salon's Right to Refuse or Cancel

The salon has the right to refuse or cancel your booking at its discretion. See Section 4 below for full details.

A.3 User Conduct

You agree not to: violate laws, harass or harm others, post false information, impersonate others, disrupt the Service, or engage in fraudulent practices.

A.4 Reviews

Reviews must be honest and based on your experience. Do not post offensive, defamatory, or fake reviews. You grant us a license to use your reviews.

Part B – Terms for Salons

B.1 Salon Registration and Accuracy

Salons must provide accurate business information (name, address, hours, services, pricing) and keep it up to date. Salons must comply with all local laws, regulations, and licensing requirements.

B.2 Professional Conduct

Salons must maintain professional conduct with customers at all times. Salons are responsible for the quality and safety of their services and premises.

B.3 Data Protection

Salons must not misuse customer data. Customer information shared via Fade (name, phone, booking details) may only be used for the purposes of fulfilling the appointment and related communication. Salons must comply with applicable data protection laws (e.g. GDPR).

B.4 Subscription and Fees

Salons must pay applicable subscription or promotion fees for premium features. Billing is via Apple/Google. Cancellation and refund policies are governed by the respective app store.

3. Salon's Right to Refuse or Cancel Appointments

Salons have the right to refuse, reject, or cancel a booking at their sole discretion when they reasonably determine that something is not in order or when refusal is necessary to protect their business, staff, other customers, or to comply with legal or professional obligations.

Grounds for Refusal May Include (but are not limited to):

  • Safety concerns: suspected threat, aggressive behavior, or risk to staff or other customers
  • Hygiene or health: conditions that could endanger staff or customers (e.g. infectious disease, severe allergies that cannot be accommodated)
  • Privacy or identity: inability to verify identity where required, or concerns about misuse of personal data
  • Capacity: salon is fully booked, understaffed, or unable to provide the requested service
  • Professional judgment: the requested service cannot be performed safely or appropriately (e.g. incompatible hair/skin condition, product allergies)
  • Fraud or misuse: suspected fraudulent booking, fake identity, or abusive use of the platform
  • Customer history: repeated no-shows, cancellations, or past misconduct
  • Legal or regulatory: compliance with laws (e.g. age restrictions, licensing requirements)
  • Other legitimate business reasons: temporary closure, equipment failure, or force majeure

Obligation to inform: When refusing or canceling, the salon should inform the customer as soon as reasonably possible. The salon is not required to disclose the specific reason if doing so would compromise safety, privacy, or legal obligations.

Fade's role: Fade does not interfere with a salon's decision to refuse a booking. Fade is not liable for any refusal or cancellation by a salon. Disputes regarding refusal or cancellation are between the customer and the salon. Customers may contact support@getfadeapp.com for platform-related issues only.

4. User Accounts (All Users)

To use certain features, you must register. You agree to provide accurate information, maintain account security, and notify us of unauthorized use. We reserve the right to suspend or terminate accounts for violations of these Terms.

5. Acceptable Use (All Users)

You agree not to: violate laws, infringe rights of others, transmit harmful content, impersonate others, disrupt the Service, or engage in fraudulent practices.

6. Bookings and Payments

When a customer books, the contract is between the customer and the salon. Fade facilitates the booking but is not a party to that contract. Cancellation and refund policies are set by individual salons. Payments are processed through third-party processors (Apple Pay, Google Pay). Fade is not responsible for disputes between customers and salons.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FADE (Vera IT) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. WE ARE NOT LIABLE FOR SALON DECISIONS TO REFUSE OR CANCEL BOOKINGS, OR FOR DISPUTES BETWEEN CUSTOMERS AND SALONS.

8. Governing Law and Contact

These Terms are governed by the laws of Germany. For EU consumers, nothing in these Terms limits your statutory rights. Disputes shall be resolved in the courts of Germany.
